Term Paper and Site Visit Instructions



Movie Night (formerly known as Site Visits)
Objective: Watch a movie which is heavily filmed in a restaurant or hotel like Maid in Manhattan, Ratatouille, Pretty Woman, No Reservations



Purpose:  Identify legal issues that have arisen in the film that you are watching.



Term Paper
Objective: Write a TWO-page, single spaced, letter to the manager of the business that you toured or the movie you watched. Include the address of the business, the name of the person who gave you the tour, their title and the day you visited should be the date of the letter. DO NOT SEND IT TO THEM. Discuss in your letter the items that they are doing correctly, also discuss the items that might get them into trouble. If you watched a movie, make up an address and put the movie as the company name.



You will not be able to write a detailed letter due to the limited nature of most of the tours. However, you should be able to take a few of the subjects listed below and provide some analysis for the manager.  I want to see LEGAL ANALYSIS, explain why they should be concerned about issues. Do not just raise issues, you need to provide legal analysis why it is an issue. In other words, pretend the manager has no idea what the law is and you need to teach him or her.



Remember you're writing to someone who might not understand the law. Explain the legal issue, what it is and why it is a concern. Please do not gloss over the analysis of the law.



Subjects: You may want to discuss one or all of these, it depends on your tour.



Possible tort violations
Civil Rights Claims
Public Health
FMLA
Contract Problems, i.e., overbooking, conventions
ADA
Guest Protection
Or anything else that you might want to discuss
Requirements:



Your letter should be in standard business letter form.  I do NOT care if the facts are 100% true, I am interested in your analysis of the legal issues. DO NOT give a movie review.
Explain possible legal problems, remember you are NOT an attorney, only explain what you see as a manager and what they should discuss with local counsel.
Tell the manager why the company should be concerned.  For example, if there is a banana peel on the ground why should an employee pick it up.
You may have to explain terms to manager. Don't just throw out legalize.
Don't tell the manager they should look something up. You're writing the letter, give some answers.
Use the address and name of the manager of the hotel or restaurant.
DO NOT INCLUDE YOUR NAME AT THE TOP. The only thing that is permissible before the letter is the manager's info and the date.
The date on the letter should be the date of the visit not the date you wrote the letter.
Turn paper in the Friday before finals start.
Single Spaced with margins that are 1" -1.25" wide. You can include one extra space between paragraphs. 12 point font. Do not add extra spacing.
If you read through your paper and there isn't a clearly defined legal issue with analysis you've not dug deep enough. Someone should be able read your paper, understand the issue, and understand how to correct it in the future. This required explaining the law, apply the law to the facts at hand, and if appropriate explain how they can fix it. The business might have a defense also, go ahead and explain that too.
